The People's Mediation Committee of Shenzhen Municipality for Copyright Dispute
The Outline of the China National Intellectual Property Strategy and the Twelfth Five-year Plan for Copyright Work (NCA Document [2011] No. 5) issued by the National Copyright Administration point out that “the mediation mechanism for copyright dispute is an important way to resolve disputes between equal civil subjects, mitigate the pressure of judicial trial and administrative enforcement and realize social harmony. During the Twelfth Five-year Plan, we will carry forward the construction of the mediation mechanism for copyright dispute according to laws, support central industry associations, economically developed provinces (autonomous regions and municipalities) and central cities to establish a batch of copyright dispute mediation agencies with public credibility, and from a civil mediation mechanism and network for copyright dispute with organic combination with judicial trial and administrative enforcement nationwide”. As instructed by Shenzhen Municipal Judicial Bureau, Shenzhen Copyright Society sponsored the People's Mediation Committee of Shenzhen Municipality for Copyright Dispute (“Mediation Committee”), which is the first professional people's mediation organization in the intellectual property right industry of Shenzhen Municipality upon the approval and registration with the Judicial Bureau of Futian District, Shenzhen Municipality on September 18, 2014. The Mediation Committee is established to mediate copyright disputes and alleviate the pressure of the judicial and administrative organs in handling intellectual property right cases. At the same time, it will refine the resolution mechanism for copyright dispute, promote development of the copyright industry, contribute to social stability and harmony and help Shenzhen do the work to build a national pilot city for copyright work.

I. Documents Required to Apply for Mediation
- Relevant evidence documents submitted by the applicant
- Provide the copy of the identity card (or military officer certificate, hometown return certificate, Mainland Travel Permit for Taiwan Residents and passport), if the applicant is a natural person;
- Provide the copy of the business license, the identity certificate (affixed with official and personal seals) of the legal representative, the letter of authorization (affixed with official and personal seals) issued by the authorizing person, and copies of the identity certificates of the legal representative and the authorizing person;
- Copyright title certificates related to case
- Relevant information of the respondent (name, contact person, contact information and correspondence address of the respondent)
- Relevant documents proving the respondent has committed an infringement
- Application for People's Mediation (the template can be downloaded from the attachment)
Note: The aforesaid documents shall be affixed with the official seal, if the applicant is a corporate legal person.
